Your Rights Under Florida HOA Law

Two distinct statutes govern association disputes in Florida. Chapter 720, the Florida Homeowners Association Act, applies to mandatory-membership homeowners associations. Chapter 718, the Florida Condominium Act, governs condominium associations. The rules, rights, and procedures differ between them, and identifying which framework applies is the first step in any dispute.

Procedural Rights & Fine Protections

Florida law gives homeowners concrete procedural protections. Under section 720.303, an association must produce requested records within 10 business days of a written request. Under section 720.305, a fine can’t be imposed without first giving the homeowner at least 14 days’ written notice and a hearing before an independent fining committee of at least three members who aren’t officers, directors, or employees of the association. If that committee doesn’t approve the fine, it can’t be imposed. Fines are capped at $1,000 in the aggregate unless the governing documents provide otherwise, and a fine under that threshold may not become a lien against the property.

Dispute Resolution Paths & Fee Shifting

Most covenant-enforcement and records-access disputes require an attempt at pre-suit mediation under section 720.311 before a case can be filed in court. Election and recall disputes follow a different track: they aren’t eligible for pre-suit mediation and must instead be arbitrated through DBPR or filed in a court of competent jurisdiction. Florida law also includes fee-shifting provisions in certain HOA matters, meaning the prevailing party may be entitled to recover attorney fees from the other side.

HOAs can place a lien on a property for unpaid assessments and, after following specific statutory procedures, foreclose on that lien. If you’ve received a lien or foreclosure notice, getting legal counsel involved early can matter.
